Holland & Knight Partner Leonard Gilbert Appointed
Co-Chair of IBA's Section of Insolvency, Restructuring and Creditors Rights
Leonard H. Gilbert, a partner in the Tampa office of Holland & Knight, has been appointed co-chair of the International Bar Association's (IBA) Section of Insolvency, Restructuring and Creditors Rights. He will serve a two-year term.
With close to 1,000 members, the IBA's Section of Insolvency, Restructuring and Creditors Rights is the most prominent international association of lawyers interested in insolvency and creditors' rights law. The Section is currently working to identify areas for harmonization of domestic insolvency laws, aimed at ensuring certainty and effectiveness in cross-border trade and other financial transactions. The Section works closely with other multinational institutions concerned with insolvency, such as the World Bank, the International Monetary Fund and the Asian Development Bank.
"We play an important roll with the United Nations Commission on International Trade Law (UNCITRAL)," said Gilbert. "We also have assisted in drafting of the model laws and legislative guides produced and distributed throughout the world. One of the more recent ones, on cross-border insolvency, was adopted by the United States as Chapter 15 of the U.S. Bankruptcy Code."
Gilbert practices in the areas of banking, commercial finance, asset based lending, creditors' rights, insolvency, arbitration and commercial litigation, as well as maintaining an active transactional practice. His emphasis has been in the representation of financial institutions and other institutional lenders. In January 2009, Gilbert will attend the World Bank's conference on insolvency and the affect on complex financial instruments in Washington, D.C.
