"Tort Reform, Plaintiffs' Lawyers, and Access to Justice"

Featuring ABF Research Professor Stephen Daniels

Lawyers are civil justice gatekeepers. How they respond to changes in the legal environment, like those brought about by tort reform, determines whether the courthouse doors will be open or closed to those seeking to avail themselves of the rights and remedies the law provides - and even what those rights and remedies will be. This presentation reports on how plaintiffs' lawyers have navigated the changes in the wake of tort reform and why the blunt statement of one is critical to access: "unless there's a way to make money practicing law, rights don't make any difference."
