DESCRIPTION:Please join the New York Fellows for a lunch and remarks by Honorable Debra Ann Livingston Former Chief Judge\, U.S. Court of Appeals for the Second Circuit. \nTuesday\, September 15\, 2026 \nIn-Person Lunch – 12:00 pm\nProgram – 12:30 pm \nOffice of Wachtell\, Lipton\, Rosen & Katz\n51 W. 52nd Street\nNew York\, NY 10019 \nJudge Livingston was appointed United States Circuit Judge for the Second Circuit on May 17\, 2007\, entered on duty June 1\, 2007\, and served as Chief Judge from September 1\, 2020\, to June 30\, 2026. She received her B.A.\, magna cum laude\, in 1980 from Princeton University\, where she was elected to Phi Beta Kappa. She received her J.D.\, magna cum laude\, in 1984 from Harvard Law School\, where she was an editor on the Harvard Law Review. Following law school\, she served as a law clerk to Judge J. Edward Lumbard of the United States Court of Appeals for the Second Circuit. \nJudge Livingston was an Assistant United States Attorney in the Southern District of New York from 1986 to 1991\, where she served as a Deputy Chief of Appeals in the Criminal Division. She was an associate with the New York law firm of Paul\, Weiss\, Rifkind\, Wharton & Garrison from 1985 to 1986 and again from 1991 to 1992\, when she elected to pursue an academic career. Judge Livingston was a member of the University of Michigan’s Law School faculty from 1992 until 1994 and was there awarded the L. Hart Wright Award for excellence in teaching. \nJudge Livingston joined the Columbia Law School faculty in 1994 and has taught there since. At the time of her appointment to the Second Circuit\, she was the Paul J. Kellner Professor of Law at Columbia\, where she also served as Vice Dean. Judge Livingston is a co-author of the casebook\, Comprehensive Criminal Procedure\, and has published numerous academic articles on legal topics. She has taught courses in evidence\, criminal law and procedure\, and national security and terrorism. \nJudge Livingston served on the Judicial Conference’s Advisory Committee on the Federal Rules of Evidence and\, from October 2017 to October 2020\, she chaired the Advisory Committee. Judge Livingston also served on the Executive Committee of the United States Judicial Conference\, upon appointment by the Chief Justice. From 1994 to 2003\, Judge Livingston was a Commissioner on New York City’s Civilian Complaint Review Board. Judge Livingston is a recipient of Columbia’s Wien Prize for Social Responsibility. She received the Federal Bar Council’s Learned Hand Medal for Excellence in Federal Jurisprudence in 2021. In 2025\, she received the Stanley Fuld Award\, the highest honor of the New York State Bar Association’s Commercial and Federal Litigation Section\, and the Edward Weinfeld Award for Distinguished Contributions to the Administration of Justice from the New York County Lawyers Association. More than entertainment\, they function as vernacular trials that invite audiences to deliberate on crime\, culpability\, and punishment. Analyzing 30 episodes (~36 hours) from five top podcasts in 2022 (Crime Junkie\, Morbid\, Dateline\, Small Town Murder\, Sword & Scale)\, Professor Nielsen identifies three patterns. First\, persona-driven storytelling shifts attention from “whodunit” to what kind of person could do this. Second\, hosts place perpetrators on a moral spectrum progressing from weird to creepy to evil to monster. The spectrum naturalizes dehumanization. Third\, gestures toward mitigation (psychosis\, intellectual disability\, trauma\, youth) typically collapse into demands for harsh punishment. This presentation will document the punitive turn within sympathetic narration and argue that these podcasts both reflect and produce legal consciousness: they teach listeners how to evaluate culpability\, weigh mitigation\, and imagine justice. \nThe Fellows gratefully recognize event host:

Many Americans\, and not just the poor\, find it impossible to take advantage of the rights and remedies the law provides. This reflects a permanent tension within a legal system grounded in deeply held notions of justice and legitimacy. This Fellows program explores an evolving innovation in the states responding to that challenge. A bold and controversial innovation with far-reaching potential for the delivery of legal services. The innovation redefines who can deliver legal services if not licensed attorneys. The program is about states as laboratories for what is\, admittedly\, an access to justice experiment. As then Washington State Chief Justice Barbara Madsen said in the 2012 order creating the Limited License Legal Technician\, the first such non-lawyer program\, “No one has a crystal ball … There is simply no way to know the answer to this question without trying it.” In 2026\, the question now is what have we learned? \nThe Fellows gratefully recognize event sponsor:
